Agreement to Terms
By using Nexi Bloom's services, you agree to be legally bound by these Terms and Conditions. It is your responsibility to read and understand these terms as they govern your use of our services. Nexi Bloom reserves the right to update these terms periodically without prior notice. Continued use of our services after updates constitutes your acceptance of the revised terms. If you do not agree to these terms, you may not use Nexi Bloom’s services.
Scope of Service
Nexi Bloom provides creative design solutions through an iterative process. Clients submit detailed project descriptions (referred to as "Creative Briefs") and receive deliverables ("Responses"). Clients may also submit feedback for revisions (referred to as "Revision Briefs") until a final product is completed.
As a client, you are responsible for preparing clear and detailed Creative Briefs, including illustrative samples and any relevant deadlines. Nexi Bloom is not obligated to review briefs for accuracy or completeness and reserves the right to reject any brief that violates these terms, lacks clarity, or is otherwise objectionable.
Failure to promptly provide feedback on delivered Responses will be considered acceptance of the design. If a client identifies issues with a Response, a Revision Brief must be submitted with detailed instructions for corrections. Nexi Bloom is not responsible for the content of designs created based on client-provided briefs.
Revision Policy
Nexi Bloom offers iterative revision cycles as part of its service:
- First and Second Revisions: Clients may request significant changes to the design, including major alterations.
- Third Revision and Beyond: Any further requests must be modifications to the current design. Major deviations from the existing design will be considered new requests and may incur a fee of $50 per revision.
No additional revisions requiring payment will proceed without the client’s prior approval. Nexi Bloom ensures timely execution of all revision requests within the agreed scope.
Packages
Nexi Bloom offers various packages, including but not limited to logo design, website design, branding, and bespoke creative solutions. Clients are charged based on their selected package and any optional add-ons. Payment must be made at the time of registration via an authorized payment method.
Refund Policy
Nexi Bloom provides a Non-Disclosure Agreement (NDA) at the initiation stage of the project, detailing the project's scope, time frame, and deadline based on consumer project requirements. The valid timeframe for refunds will be declared within the project's specifics.
Refunds will not be provided in the following cases:
- Projects that proceed to the second revision phase.
- Orders involving rush services, such as 24-hour design delivery.
- Inactivity on the client’s part for 30 days without notification to Nexi Bloom.
Approved refunds will be processed within 6-7 business days, less a 10% service fee. After 60 days of inactivity, reactivation of a project will require a $350 reactivation fee. Clients who accept a refund forfeit any rights to use the designs provided and acknowledge that Nexi Bloom retains ownership of all unused concepts.
Responsibilities and Liability
Client Responsibility
Nexi Bloom is not responsible for verifying the accuracy, legality, or compliance of any project content provided by the client. Clients must ensure that any photos, images, or graphics included in their briefs are royalty-free and appropriately licensed for use.
Disclaimers
Nexi Bloom provides all services "as is" without warranties of any kind. We disclaim any implied warranties, including but not limited to:
- Fitness for a particular purpose.
- Non-infringement of third-party intellectual property.
- Accuracy or reliability of deliverables.
Nexi Bloom is not liable for any indirect, incidental, or consequential damages, including lost profits or business interruptions, arising from the use of our services.
Hosting Services Specific Terms
Data Hosting and Management
Nexi Bloom provides hosting services where clients can store their website files, databases, and other digital content. Clients are responsible for ensuring their data is lawful and complies with all applicable regulations.
Service Uptime and Maintenance
Nexi Bloom strives to provide a reliable hosting service with minimal downtime. Scheduled maintenance will be communicated in advance whenever possible. However, Nexi Bloom cannot guarantee uninterrupted service and is not liable for any data loss or interruption caused by external factors beyond our control.
Billing & Account Suspension
A $5 daily penalty will apply if payment is delayed beyond the 5-day grace period. If the account remains unpaid for 10 days, it will be suspended. To recover a banned account after this period, please contact our support team for further assistance.
Backup and Data Recovery
Regular backups of hosting data are performed to ensure data integrity and availability based on consumer subscription package. Clients are also encouraged to maintain their own backups. In the event of data loss, Nexi Bloom will assist in data recovery efforts but cannot guarantee the restoration of all lost data (if outside consumer's package coverage).
Acceptable Use Policy
Clients must adhere to Nexi Bloom’s Acceptable Use Policy, which prohibits the use of our hosting services for illegal activities, distribution of malware, spamming, or any activity that disrupts the service for other users. Violation of this policy may result in immediate suspension or termination of hosting services without notice.
Indemnification
Clients agree to indemnify Nexi Bloom against any claims, damages, or expenses resulting from a breach of these terms or misuse of the service.
Ownership and Usage Rights
Upon project completion, clients retain ownership of the final deliverable. However, Nexi Bloom reserves the right to use non-selected designs and concepts for promotional purposes. Clients do not acquire trademark or copyright rights through this agreement, and Nexi Bloom assumes no responsibility for securing intellectual property protection for the final deliverables.
Client Accounts and Security
Clients are responsible for maintaining the confidentiality of their account credentials. Nexi Bloom must be notified immediately in case of unauthorized account access or suspected security breaches. Failure to comply with these obligations may result in account suspension or additional security requirements.
